I thought he was owed the next spot on the court. Would this kill that option or could he just be moved if a spot opened? Or would the next pick need to be more to the left to begin to balance the court?

It’s not unprecedented. Tom Clark, for one, went from being Truman’s attorney general to the Supreme Court in 1949. Before him, FDR made the same move with Robert Jackson in 1941. Also Coolidge with Harlan Stone in 1925. Et al., probably.
Garland is too old to put on SCOTUS. We need to appoint people in their 40's like the R's do.

I have to believe that Biden and Garland had a conversation on that, and for whatever reason AG was the best option.
Actually Biden kept repeating that he would nominate the first African American woman to the Supreme Court.
Any ideas on who that might be?
